Conflicts of use at sea - crossroads on the need to reconcile human activities in European waters (18 and 19 November 2021)

Within the framework of the Institute Sociétés en Mutations en Méditerranée (SoMuM), the colloquium "Conflicts of use at sea - crossed views on the necessary conciliation between human activities in European waters" is organised by the Centre d'Études et de Recherches Internationales et Communautaires (CERIC), with the participation of the Institut du Droit économique de la Mer (INDEMER, Monaco).

At the beginning of the 21st century, the sea is a space where economic, ecological and geostrategic issues are concentrated. In addition to the intensification of traditional activities such as fishing and maritime transport, new activities are appearing or developing in increasingly remote areas, such as aquaculture, energy production at sea, carbon storage or the use of drones. This growing development of activities at sea makes the maritime space a meeting place for multiple interests that sometimes overlap and compete.

Used in other disciplines, the notion of conflicts of use is also applied in law. At sea, the notion can a priori be understood as the meeting of competing - or even incompatible - uses of the maritime space or its resources. However, competition between activities has a legal dimension insofar as the activities in question are subject to the application of distinct legal rules which do not always allow for consistency. This competition can be taken into account upstream by the law, when it prevents conflicts or provides for the modalities of their resolution, but it can also result from a lack of consideration of this situation by the law. Behind the conflict between activities, the question of the conflict of norms and the conflict of competences arises.

The first objective of these days will be to try to specify and delimit the contours of the notion of conflicts of use. These theoretical prerequisites will then allow us to identify, in a more practical way, examples of conflicts between "users" of the sea. Finally, these days will invite to reflect, on the one hand, on the consequences generated by these conflicts of use, and, on the other hand, on the means mobilized or mobilizable to solve them, or even prevent them.
